Mandatory arbitration clauses have proliferated in employment contracts in recent years, preventing American workers from pursuing justice in the courtroom and, instead, forcing them to pursue their claims in a private forum, chosen by their employers.


Many of the same American workers are subject to waivers of class or collective action claims, rendering many low dollar claims economically untenable to pursue. However, mass arbitration is now being employed by some as a strategy to file hundreds of near identical arbitration claims against a single defendant. Mass arbitration was recently utilized in a local case entitled James DuCharme vs. DST Systems, Inc., 2017 SL 7795123 (W.D. Mo. 2017). Our presentation will tell the story of mass arbitration, along with lessons learned, through that case.
